Just a few weeks ago, the Petito family filed a lawsuit in the sum of $100,000 against the family of Brian Laundrie for violation of their constitutional rights saying that they knew that Brian Laundrie had already killed their daughter, Gabby Petito, and were in the process of trying to help him leave the country when he disappeared.

Brian Laundrie disappeared on Sept 13th, 2021 according to his family he had gone to the nature reserve to “clear his head” as he so often did. The family lawyer, Steven Bertolino, said in an interview that Brian was “upset” and “grieving” when he left, and most recently an anonymous source reported to The Sun that it was because Laundrie had been led to believe that his Mother, Robert Laundrie, would be the one to get arrested and that is why he left.

Five weeks later, Brian Laundrie’s remains were found, according to investigators he died of a single gunshot wound to the head. Although the details of his death are a bit dodgy, considering he allegedly pulled the trigger with his non-dominant hand (left) and it took authorities five weeks to find Laundrie’s remains but it only took the Laundries themselves 20 minutes to find their son when they went to look in the nature reserve.

There was also the strange, single tear reaction that Brian Laundrie’s Mother had to finding her son’s body. The source said that Robert Laundrie is blaming herself and totally painted the Laundries as victims in their report, but the court of public opinion really isn’t buying it.

Now Steven Bertolino, the lawyer for the Laundrie family, is saying that the lawsuit is “baseless and frivolous” and has filed a petition to have the lawsuit thrown out. Bertolino claims that the Laundries had a fundamental constitutional right to silence and the right to have legal counsel speak for them.

Bertolino is confident that the suit will be thrown out, but will it? What judge in their right mind would deny a grieving family their right to have justice for their daughter? Then again it is Florida and Florida is often the state that doesn’t make sense, but there is something about this case that just doesn’t seem right.

It doesn’t set well from a legal standpoint, even from a layperson’s perspective, that this kind of suit would be thrown out. So we at DSD will be following this case to see exactly where it goes. Stay tuned!!!
