Gabby Petito‘s family is determined to receive some kind of justice for their daughter by making an example of the Moab Police Department.
They allege in the new lawsuit they have filed that the Moab PD is responsible for the death of their daughter and that they wrongfully determined Gabby to be the aggressor in the altercation between her and then-boyfriend Brian Laundrie and that Moab did not properly train it’s officers to asses this kind of domestic dispute.

The Petito’s say that if the situation had been correctly assessed by officers that they are sure that their daughter would still be alive and with them.
“No one here, the four of us, don’t want to be here. We’d give it up in a second if she was back.” said Father Joseph Petito. Her Mother, Nicole Schmidt said, “We feel we need to bring justice because she could have been protected that day. There are laws put in place to protect victims and those laws were not followed, and we don’t want this happening to anyone else.”
Indeed, these were the exact sentiments echoed by their lawyer, James W. McConkie. “The purpose of this lawsuit is to honor Gabby’s legacy by demanding accountability and working toward systemic changes to protect victims of domestic abuse and violence and prevent such tragedies in the future.”
Of course the Moab police department issued a statement saying that they would defend themselves against the lawsuit, denying any wrongdoing in the Gabby Petito case. “The death of Gabrielle Petito in Wyoming is a terrible tragedy, and we feel profound sympathy for the Petito and Schmidt families and the painful loss they have endured.
At the same time, it is clear that Moab City Police Department officers are not responsible for Gabrielle Petito’s eventual murder.” the maintain that the police involved acted with “kindness, respect, and empathy” during their interaction but went into say that the Petito lawyer is acting like the officers could predict the future when no one could have.
While they have a point, the fact of the matter is that a lot of people saw in the video that Gabby Petito was clearly being abused by Brian Laundrie, people who are not even experts in the field, so we wonder why Moab Police department couldn’t see the same exact thing considering they were up close and personal with the victim.
