Nirvana’s Nevermind album is one of the nosy acclaimed albums in the history of music and synonymous with the ’90s. It would be difficult to find an American who grew up in the ’90s who couldn’t recognize the groundbreaking 1991 album’s cover of a baby boy swimming after a dollar bill.
Now, 30 years after the album dropped, that baby boy is all grown up…and still chasing after those dollar bills.
Spencer Elden claims he’s the famous naked baby in the swimming pool and is now suing the band’s surviving members and Kurt Cobain’s estate for child sexual exploitation.

According to Elden’s federal lawsuit, he claims he was unable to consent to his image being used on one of the best-selling albums of all time’s cover–being that he was only 4 months old. He also claims his legal guardians at the time did not give their consent, either.
Elden also alleges in his suit that the band promised to cover his genitals with a sticker, but it was never incorporated on the album cover. Elden has therefore decided the image is child pornography.
Elden is suing the members the band – Krist Novoselic, Dave Grohl and the late Kurt Cobain via his estate along with the record labels that released or distributed the album in the last three decades for failing to protect and prevent Elden from being sexually exploited.
Nevermind is often credited with initiating a resurgence of punk culture among teens and young adults of Generation X and is touted as being partly responsible in part for bringing both grunge and alternative rock music to a mainstream audience, ending the reign of hair metal.
The album has sold over 30 million copies worldwide and Elden claims having his naked baby body with exposed genitalia being brought home to almost every second teenager’s home in the ’90s caused him to suffer lifelong damages. He is suing for a minimum of $150,000 from each of the 15 parties he believes wronged him.
