    The Murder Case Against Brother of Olympic Gymnast Simone Biles Declared a Mistrial

    A judge has declared a mistrial in the murder case against Tevin Biles-Thomas, the brother of Olympic gold medal winning gymnast, Simone Biles.

    Biles-Thomas, of Cleveland, Ohio has been charged with murder, homicide, voluntary manslaughter, felonious assault and perjury.

    This is all in connection with a triple fatal shooting at a 2018/2019 New Year’s Eve house party. Biles-Thomas was a part of a group who decided to attend the party even though they had previously been uninvited.

    An altercation between this group and other party-goers lead to shots being fired and three fatalities.

    Delvante Johnson, 19 and Toshaun Banks, 21 were pronounced dead at the scene while a third man, Devaughn Gibson, 23 died after being rushed to hospital.

    Biles-Thomas was taken into custody on August 29, 2019, at Fort Stewart, Georgia while awaiting his trial which began May, 2021.

    Unfortunately an Ohio judge had to declare a mistrial on Tuesday, May 25 after jurors informed the judge that legal paperwork was unintentionally included in the evidence they had to review. The legal paperwork was read by the jury during their third day of deliberations.

    The paperwork included copies of legal briefs from Biles-Thomas’ lawyers and prosecutors deliberating over whether Biles-Thomas might have been acting in self-defense against Gibson, the third man who died in the shoot out.

    They agreed this influenced their thinking and they were unable to continue deliberating on just the evidence deemed admissible and provided at the trial.

    A new trial began again on Wednesday, May 26, 2021, with a new jury selection.

    Biles-Thomas, a U.S. Army soldier has plead not guilty.

    As for his famous sister, Simone Biles put out a statement after the deadly party saying she was having a hard time processing the news,  struggling with her brother’s arrest and that her heart ached for the victims and their families.

    Gymnast, Biles did not grow up with biological brother, Biles-Thomas. She was 3 when she, Biles-Thomas and two other siblings were placed in foster care because of their biological mother’s drug and alcohol abuse.

    Simone is currently preparing for the 2021 Olympics in Japan.
