There’s a new report that says Erika Jayne is in the clear as she has been dismissed from her estranged husband Tom Girardi’s fraud and embezzlement lawsuit. Here’s what you need to know.
New legal documents say, “Pursuant to stipulation, plaintiff’s claims against defendants EJ Global LLC and Erika Girardi are dismissed without prejudice and without costs.” This all comes after a ruling came one day after both parties agreed “dismissal is appropriate,” according to a separate filing.

As many fans and critics know by now, Erika Jayne pulled the plug on her marriage to Tom Girardi in November of 2020. The former couple is being accused of using their divorce to embezzle money and hide assets from the victims of Lion Air Flight 610 in a lawsuit that was filed the following month.
Just recently, Erika was slammed for “inexcusable behavior” by her “RHOBH” co-star Sutton Stracke. She said that she’s not buying into Erika’s claims that she didn’t know anything about her estranged husband Tom Girardi’s legal problems.
Back in November and during a Real Housewives of Beverly Hills reunion special, Erika told Andy Cohen that she didn’t know why she was being sued.
“This is a very long bankruptcy that will be pulled apart, both his firm and his personal bankruptcy,” she said of her ex. I am being sued by everyone who thinks I’ve got some magical pot of gold at some rainbow.”
Erika continued, “If that is proven, what money is allegedly misappropriated, when and how? Does that mean every lawyer’s salary should be clawed back? Does that mean every secretary’s salary needs to be clawed back? Or the referring attorneys or anyone else that’s in that business?”
