Glee star, Naya Rivera’s tragic drowning still affects her family, friends and fans almost 2 years after her death. It seems the suffering with be ever so sightly eased for her son, Josey now that the wrongful death lawsuit, filed by Rivera’s ex-husband Ryan Dorsey on behalf of their son, is settling.

The 33 year old actress was confirmed dead on July 13, 2020 — five days after she went missing during a boating trip with her son on Lake Piru in Southern California.

Dorsey and Rivera’s estate filed the lawsuit against Ventura County, it’s Parks and Recreation Management and the United Water Conservation District in November 2020, arguing that the Santana Lopez portrayer’s death was preventable.

Court docs state that the boat Rivera and her son rented from Lake Piru did not comply with safety standards as laid out by the U.S. Coast Guard. The lawsuit also mentioned that, despite Lake Piru’s “deadly history”- over  two dozen people have drowned in the lake since 1959- no signs have been erected to warn boaters or swimmers of dangers like “strong currents, low visibility, high winds, changing water depths, underwater caves, ledges and drop offs, or the trees, brush and other debris that congest its waters due to the vastly changing water levels and winds.”

While Rivera’s death was ruled as an accidental drowning she also died a hero, saving her son’s life by getting him back on board the boat before submerging into the lake and never resurfacing.

The undisclosed settlement reached in the case is subject to approval by the Ventura Superior Court, to be ruled upon later this month.

A spokesperson for Rivera’s family and estate made a statement regarding the settlement, saying, “Through this settlement,[6 year old] Josey will receive just compensation for having to endure the drowning of his beloved mother at Lake Piru. Though the tragic loss of Josey’s mother can never truly be overcome, we are very pleased that the monetary settlement will significantly assist Josey with his life beyond this tragedy.”
