Finally, the wheels of justice are slowly starting to turn for the family of Gabby Petito. Today, Judge Hunter W. Carroll ruled against Chris and Roberta Laundries’ motion to dismiss the case against them, issuing the following statement: “Because the Laundries’ statement by their attorney in the context of the unique facts of this case is objectively outrageous, the Court concludes that Plaintiffs have states causes of action for intentional infliction of emotional distress against the Laundries.

The Court denies the Laundries’ motion to dismiss.” the civil suit in question is exceeding the amount of $30,000 plus attorney’s fees.

Judge in Gabby Petito case denies Laundries’ motion to dismiss

In their motion to dismiss the lawsuit, the Laundries stated that the amount of media notoriety that the case had would make it difficult to find a jury that was actually unbiased. They also claimed that since Gabby’s body had been found, and because it had happened months ago, meant that the whole matter was resolved. No, we’re not kidding.

They really said, with their entire chest, that because Gabby Petito’s body was found and because it had happened months ago, that the whole matter was resolved. As if finding her body was the resolution that this family actually wanted. As if you just magically get over losing a child.

You would think, having lost her own son, that Roberta Laundrie would have sympathy for Nicole Petito and would want to do anything that she asked, but her son took his life because he wanted to, he got a choice in the matter. Gabby, no matter what the letter that Brian Laundrie scribbled in his last moments, says, did not get a choice in the matter.

It’s strange how the letter says that Gabby got hurt, but doesn’t really specify how she got hurt, we know that she had blunt force trauma to her head according to the autopsy, but now with the letter being released we get a clearer picture of just what went on, and we hope that the judge has as well. There’s a reason he didn’t dismiss this case, we at DSD will continue to keep an eye on it. Stay tuned!!!
