Leave it to Josh Duggar‘s legal team to try and get him out of this one. They have been pressing the courts about his possession of child pornography case and now it looks like they have made even more motions to try and get him out of these charges.
Now, the Countin On cast member’s legal team is bringing up a lot of evidence that they feel should be thrown out of his case. Some of the evidence is questionable and by the looks of it, the team is even trying to get the whole case thrown out. What will happen with Josh and his team? What are they trying to get thrown out?
Counting On: Josh Duggar and Evidence Against Him
There is a lot of evidence that Josh and his legal team want to be thrown out immediately. Some of this evidence goes back to 2019 and was found at his used car dealership. His team thinks that this evidence does not have any weight on the case and was seized by improper measures.
They said that the computers seized were all for his car dealership, but according to the feds, there is a lot of child pornography found on them as well. This is one of the main reasons that the courts may not think it is a good idea to throw out this evidence.
When the search of his dealership was happening, Josh told the feds that he wanted to call his lawyer. According to Duggar, the feds told him that the warrant they had also was to take his iPhone. This is when they took him into questioning and Duggar claims that they would not let him get a lawyer at this time.
He also stated that there was never a lawyer present while he was being interrogated. This is one of the main reasons that he feels this evidence needs to be thrown out.
Duggar’s legal team spoke out this week, “Duggar communicated his intent to seek advice from his attorney and federal agents physically stopped him from exercising his constitutional right to do so. Then, after preventing Duggar from seeking legal advice and after physically taking his iPhone from his hand, law enforcement again approached him to interrogate him. The interaction involved law enforcement officers swarming the premises and physically taking an iPhone out of Duggar’s hand under circumstances that would intimidate any person.”
This case continues to go on and we won’t know much about the decision until November, when Duggar goes to trial.
