Josh Duggar’s attorneys have asked the courts for an extension, to push the disgraced reality star’s trial back to February 2022.

The eldest of the 19 Duggar children has been charged in a two-count indictment. One count of receipt of child pornography and one count of possession of child pornography are the two charges pressed against the devout Baptist.

Duggar spent 6 days in jail following his volunteer surrendering the Washington County Jail on April 29. He was released on May 5 and into the custody of a third party. Duggar is currently living quite comfortably with LaCount and Maria Reber, longtime friends of family patriarch, Jim-Bob Duggar.

The four bedroom home, un upgrade from the warehouse where he lived with pregnant wife, Anna and six kids (and a definite upgrade from a jail cell) is nicely secluded on 9 acres with a long driveway.

According to the motion to delay proceedings, the defense has acquired the skills of an independent computer forensic expert. The expert will conduct a computer forensic examination of each of Duggar’s devices on which the prosecution alleges contained child pornography.

The defense claims this time-consuming process requires review at a government facility and the analysis may take several months.

Duggar’s lead counsel, Justin Gelfand is also a busy man. He has federal criminal trials scheduled in July 2021, September 2021, October 2021 and November 2021. The rapid succession of cases is due to them all being pushed back because of the COVID-19 pandemic.

While Duggar awaits news of whether his trial will be delayed, he currently lives free…but with certain restrictions.

He is restricted (with GPS monitoring) to his custodian’s home (where minor children cannot be present) except for court obligations, church, etc. Additional locations must be pre-approved by the probation officer he is obliged to report to regularly.

He is not allowed online or to use electronics and is banned from viewing any erotica. He cannot possess control substances or firearms and was forced to surrender his passport.

Contact with his own children is allowed so long as his wife is present. If Duggar violates any of these conditions an additional prison sentence of up to 10 years may be imposed.
