    Depp V. Heard: Jury Deliberates And Asks For Clarification On Heard’s Op-Ed – Is The Title A Case For Defamation?

    The jury has been deliberating for the Johnny Depp vs. Amber Heard trial and so far has only come to ask for clarification on one thing and it had to do with Amber. They wanted guidance on how to handle a defamation claim, and Johnny is suing Heard for three statements specifically that were featured in the op-ed. Were they supposed to look at the headline by itself or as a part of the entire op-ed?

    The headline they’re referring to is the one that appeared in the digital version of the 2018 Washington Post piece … “I spoke up against sexual violence — and faced our culture’s wrath. That has to change.”

    The answer from Judge Penney Azcarate was to look at the headline on its own and decide, by itself, if it was defamatory without the rest of the article for context. Now, they’ll continue to deliberate and we expect a decision soon.

    While it’s going to be difficult for Johnny to win a defamation case, the juror’s question may prove to be even worse for him. While it’s pretty obvious that Heard has lied and embellished a lot, if there was any domestic abuse from Johnny, even verbal and emotional, she would technically be right on its face value by saying she was speaking out against domestic violence, even though what we heard and seen in the court case shows that she made up a lot of things. Even if one thing happened, technically, she’s not lying in those lines.

    While the general public may think this is an easy win for Depp, they may be surprised to hear that he might lose this one, even if it is on a ‘technicality’.
