Alec Baldwin will be prosecuted with involuntary manslaughter for the on-set death of Rust cinematographer Halyna Hutchins in 2021, according to New Mexico prosecutors’ announcement on Thursday. Through his attorney, the actor declared his intention “to defend” the allegations. What does all of this mean for the 64-year-old actor?
Armorer Hannah Gutierrez-Reed and Baldwin are both charged with two counts of involuntary manslaughter. They will be “charged in the alternative,” which means that the jury will choose which definition of involuntary manslaughter they are guilty of in addition to whether they are guilty overall. The D.A.’s office must demonstrate underlying carelessness for the first charge, involuntary manslaughter, to be proven true. The second charge, involuntary manslaughter in the commission of a lawful act, calls for evidence that the death was caused by more than just negligence.

It will be interesting to watch this unfold and if Baldwin will actually be charged and spend time in jail. Or, will he get the Hollywood treatment and sentenced to something like house arrest in his mansion? There is no doubt that he should have to pay some kind of time for his actions, as many of us would if we were in the same situation.
Baldwin’s version of events will be examined by specialists if this goes to trial. The 30 Rock actor said he did not fire the shot. Baldwin said that he pushed back the hammer during rehearsals at the cinematographer’s request, but not far enough to actually cock the gun. Baldwin accused Halls, Gutierrez-Reed, and other crew members for Hutchins’s death in his own lawsuit complaint.
Before the month is out, Mary Carmack-Altwies, the First Judicial District Attorney for New Mexico, will formally bring the charges.
