Will Thomas Markle Win In His Court Battle Against Prince Harry And Meghan Markle?

While there’s no doubt that Thomas Markle has had a hard time seeing eye-to-eye with his estranged daughter Meghan Markle, all he wants to do is meet his two grandchildren, Archie Harrison and Lilibet Diana, especially since they now live so close to him.

In fact, Thomas recently said that he plans on taking his daughter and her husband Prince Harry to court in order to win his visitation rights as a grandparent to his two grandchildren. However, there is a new report that suggests that might not be very easy. Here’s what you need to know.

According to reports, Thomas Markle recently announced that he plans on taking the Duke and Duchess of Sussex to court over the right to see his two children.

The Sussexes live in Montecito, Calif. while Thomas lives just across the border in Mexico. He told Fox News last week, “I will be petitioning the California courts for the rights to see my grandchildren in the very near future.”

However, one royal expert believes that Thomas’ “negative feelings” towards Harry and Meghan could affect his battle to see Archie and Lilibet. At least that’s what legal expert Lisa Harbour believes.

She told Entertainment Daily in a new interview, “As grandparents do not automatically have parental responsibility, they must first apply for permission to make an application to spend time with the children. Of course, the Courts will always act in what they believe to be the child’s best interest.”

She added, “They would consider the nature of the proposed order; the applicant’s connection to the child; their previous involvement in the child’s life; and any risk of potential disruption to the child’s life.”

Lisa, who is an Associate and Family Law Executive at Jackson Lees, also said, “If permission were granted, the Court would then consider any application for a Child Arrangements Order on a case by case basis. It is important to remember that, at each stage, the child’s welfare is paramount. It’s likely that the Court would also consider how the matter has been played out in the media.”
