Prince Andrew’s Legal Team Says Virginia Giuffre Can’t Sue In U.S. Because She Lives In Australia

It looks like Prince Andrew is trying to get away with his supposed sins from the past with a technicality. But whether or not this will work in his favor, no one knows. There’s a new report that says the Duke of York’s legal team is arguing that Virginia Giuffre cannot sue in the United States because she currently lives in Australia. Here’s what you need to know.

Back in October, Prince Andrew had asked a U.S. court to dismiss Virginia Giuffre’s sexual abuse lawsuit, as his legal team believes it’s “frivolous.” Virginia alleges that she was forced to have sex with the Duke of York on a number of occasions while she was still a minor.

But now his lawyers are saying that the case shouldn’t proceed forward just because Virginia is no longer a resident of the United States.

Andrew B Brettler, in documents filed for the 61-year-old on Tuesday in the Southern District Court of New York, said the case should be halted until the “issue of subject matter jurisdiction is adjudicated.”

“Recently discovered evidence suggests that the court does not have subject matter jurisdiction over this action because Plaintiff Virginia L Giuffre cannot satisfy the elements of diversity jurisdiction,” Mr. Brettler wrote in the documents seen by the PA news agency.

“Notwithstanding that, in her complaint, Ms. Giuffre alleges she is a citizen of the state of Colorado, the evidence demonstrates that she is actually domiciled in Australia, where she has lived for all but two of the past 19 years. It is undisputed that, at the time she filed this action, Ms. Giuffre had an Australian driver’s license and was living in a A$1.9 million (£1 million) home in Perth, Western Australia, where she and her husband have been raising their three children.”

He added, “In reality, Ms. Giuffre’s ties to Colorado are very limited. She has not lived there since at least 2019 – approximately two years before she filed this lawsuit against Prince Andrew – and potentially, according to her own deposition testimony, not since October 2015.”
