Brad Pitt Is Now Dragging Out His Custody Battle Fight With Angelina Jolie

It seems like their divorce and online custody battle is lasting longer than their actual marriage. As a matter of fact, there are new reports that say Brad Pitt is now challenging Angelina Jolie’s win in their child custody case. Back in July, Angelina scored a major victory when a California appeals court agreed with her that the private judge who decided who should get custody of her children with Brad Pitt should be disqualified. Reports said  that the 2nd District Court of Appeal agreed with the actress that Judge John W. Ouderkirk didn’t sufficiently disclose his relationship with Brad’s attorneys. Ouderkirk, a private judge, was hired by the former couple in a bid to keep details of the divorce out of the public eye. His departure is likely to further extend the custody dispute. Judge Ouderkirk declined to hear evidence which Jolie’s side believes is “relevant to the children’s health, safety, and welfare, evidence critical to making her case.”

“Judge Ouderkirk’s ethical breach, considered together with the information disclosed concerning his recent professional relationships with Pitt’s counsel, might cause an objective person, aware of all the facts, reasonably to entertain a doubt as to the judge’s ability to be impartial. Disqualification is required,” the court ruled.

And now Brad Pitt is fighting back, arguing that his ex should not have gotten custody of the couple’s children due to an administrative error by a temporary judge whom they jointly selected, according to documents filed in California Supreme Court. Brad’s team says they believes that any error made by Ouderkirk was minor and not worth vacating his custody ruling. It also claims Jolie was looking for any reason to get the jurist removed from the case.

“We are seeking review in the California Supreme Court because the temporary judge, who had been appointed and repeatedly renewed by both sides, was improperly disqualified after providing a detailed, fact-based custodial decision, following a lengthy legal process with multiple witnesses and experts,” Pitt’s lawyers said in a statement.

“The lower court’s ruling will reward parties who are losing child custody cases, and condone their gamesmanship, by allowing them to wait and see about the likely direction of the case before seeking the disqualification of the judge,” his lawyers argued in their statement.

“Condoning the use of this type of strategic ‘lie in wait’ disqualification challenge will cause irreparable harm to both the children and families involved in this case, and other families in other cases, by unnecessarily prolonging the resolution of these disputes in an already overburdened court system. Allowing this kind of crafty litigation strategy will deprive parents of irreplaceable time with their children as judges are disqualified for minor reasons in the midst of their cases.”
