    According to people familiar with the investigation, federal agents looking into President Joe Biden’s son Hunter have gathered what they consider to be enough proof to accuse him of tax offenses and making a false statement in connection with the purchase of a firearm. The U.S. Attorney in Delaware, a holdover from the Trump administration, will now decide whether to bring such charges, according to these sources.

    Hunter Biden’s investigation started in 2018, and then-president Donald Trump made it the center of his unsuccessful 2020 reelection campaign. The initial focus of the inquiry was on Hunter Biden’s financial connections to and consulting work with foreign companies. According to the people with knowledge of the matter, who spoke on the condition of anonymity to discuss an ongoing case, investigators from various agencies spent considerable time looking into whether he failed to disclose all of his income and whether he falsified paperwork when buying a gun in 2018.

    Months ago, agents decided they had a strong criminal case against the younger Biden. But in situations where prosecutors believe the evidence is sufficient to likely result in a conviction at trial, it is ultimately up to prosecutors at the Justice Department, not agents, to decide whether to file charges.

    The primary objective of the tax investigation has been to determine whether Hunter Biden failed to disclose any income from his various business ventures, including those that took place abroad. The investigation’s focus on the gun paperwork dates to 2018, a time when Hunter Biden, by his own admission, was using crack cocaine.

    Although they are not common, prosecutions for making false statements on gun purchase forms do occur. Such situations are described as “lying and buying” by federal agents. Prosecutors traditionally exercise considerable discretion in determining which cases merit federal funding.
