TLC 90 Day Fiancé spoilers finds a lawyer that breaks down the process of a non-immigrant visa. The visa, otherwise known as the K-1 visa is a long and complicated process. A K-1visa is a legal document for a U.S. citizen to bring his/her foreign fiance to the United States. Most of what goes on in the series is not what actually happens. Sure, we may have known this. It is a reality show but what exactly is the process like? Surely they can’t show us the long, lengthy process altogether so they try to cut and paste it together in “90 days”.

There’s a lot that must happen for a K-1 visa to be accepted. The show makes the 90 days feel like the most important part, but really there are many hurdles before that even begins. For one, it must be decided if the person but outside the country will become a legal burden on the country. This is determined by the applicant’s work history, skills, age, and criminal record. If the person in question has a criminal record there is not a very good chance they will be accepted. There are ways to attempt to waive past offenses. Like a drug possession over 10 years ago could be rebutted if the person shows that they are changed from then.

The second biggest thing is showing financial responsibility. The U.S does not want people to come in who are not going to work or be a burden to the system. This has a multitude of factors including the person’s age and tax returns. If it is decided that they cannot financially support themselves, it can be picked up by the U.S citizen attempting to bring them in. They must show they have the capability of supporting another person while maintaining essentials, like housing, clothing, and food.

Even after all of these requirements, the two in question must have met in person within the last two years. It doesn’t seem so difficult, however, this has become a huge part of the show. Most of the time, the two spend a very short amount of time together before deciding to marry. Then, the lengthy process of documents begins, as well as the 90-day time frame of deciding to marry.

TLC 90 Day Fiancé Spoilers: CR-1 Visa’s And A Minimum Time Of Marriage

If a couple decides to get married in another country, they must file for a CR-1 visa. For instance, if a U.S. citizen went to Mexico and married there, in order to bring his/her partner back, instead of filing for a K-1, they’d have to do a CR-1. While a lot of the documents are similar, this way may be a lot tougher due to the recent travel ban. We’ve seen this on the show before, dealing with Syria.

Assuming everything goes right, and the K-1 or CR-1 visa is accepted, the couple must remain married for at least two years for the applicant’s visa to stay eligible. If they divorce or separate before the two years, the applicant may lose the ability to stay here and have to go back to their country.

If an applicant comes for one person, but they end up with another, they’d have to start the process all over again. For instance, if a woman married a man from Australia and applied for the K-1, the Australian man would have to stay married to that woman, he would not be able to divorce/separate and marry another.

The U.S. citizens are limited to two K-1 visas in their lifetime! So if the first doesn’t work out they only have one more chance. This isn’t put in place to be mean, but to help deter fraud. If a person was allowed to have as many as they wanted, it would make way for darker reasons to get the visa. This could include human trafficking and more.

The man behind the video does a very good job of breaking down the process. He even takes a few jabs at the show 90 Day Fiancé. He thinks it seems silly that two people who may not even speak the same language can up and “fall in love” so quickly. While I tend to agree it’s pretty crazy, that’s why we watch it! We understand 90 Day Fiancé is reality television and we watch for the drama.
